Job Title : Consultancy to Conduct a Legal & Policy Analysis

CARE is an international humanitarian organisation fighting global poverty, with a special focus on working with women and girls to bring lasting change to their communities. CARE is seeking a highly qualified candidate to fill the consultancy position as Consultancy to Conduct a Legal and policy analysis
for 20 days, The Consultant, To conduct detailed analysis of Sexual Harassment (SH) / Gender Based Violence (GBV) measures through Cambodia’s Labour / DV / criminal legal and policy frameworks.  This will include general assessment, as well as a particular focus on workplace and community level protections, to clarify obligations of key duty bearers, identify leverage points for strengthening protections, identifying gaps and assessing particular implications or barriers for marginalized urban women.  The analysis will inform the development of appropriate workplace and community level protections and measures to be supported by CARE and our partners.  It will be a key resource for a range of stakeholders working to strengthen SH/GBV workplace and community protections for marginalized women. The analysis will be conducted in consultation with key partners and stakeholders.

Job Requirement :
  • Relevant qualifications such as postgraduate degrees in law, labour or gender justice
  • Strong understanding of sexual harassment and gender based violence protections, particularly in a low resource environment
  • Demonstrated experience in conducting legal and policy analysis, including through a gender lens
  • Excellent communication, consultation and report writing skills
Job Duties :
  • Overall Scopes and Responsibilities
  • Develop a consultancy work plan, outlining key milestones and consultative processes.
  • Conduct a thorough literature review of relevant analysis previously conducted in Cambodia, analysis from Cambodia, the region and globally.
  • Conduct a thorough analysis of the legal / policy frameworks around SH/GBV in Cambodia. This will include, but not be limited to analysis of
  • Overarching frameworks and commitments under international and regional conventions and agreements
  • The legal and policy framework around gender based violence (domestic violence); including proposed administrative instructions
  • The legal and policy frameworks around labour protections, particularly on sexual harassment
  • Safe Village/Commune/Sangkat Policy
  • The Criminal Code
  • The analysis will include through consulting project staff, partners, key government agencies, employer bodies, CSOs, and women workers.
  • Conduct an analysis of existing workplace protections through selected examples, through a legal lens and assessing effectiveness.
  • Prepare a draft consultancy report, which includes, but is not limited, to
  • A succinct, clear summary of the current situation, key influences, leverage points and challenges or barriers to accessing legal protections
  • Recommendations to inform the development of practical workplace policies and other mechanisms to provide workplace protections for women workers, including proposed simple, practical guidelines for workplace policies
  • Recommendations to inform the development of practical guidelines and mechanisms to strengthen actions by duty bearers at local levels, including proposed simple, practical guidelines for actions by Commune Councils
  • Develop recommendations to inform future legal reform and policy development processes
  • Develop a final report, in line with expectations outlined
  • Participate in a one day meeting led by CARE Cambodia to discuss implications of the legal / policy landscape on future interventions.
